- Referral activity: referral link clicks and resulting applications, used to attribute and reward referrals.
- Technical data such as limited device/browser information and locally stored identifiers used to make referral links work.
How we use your data
- To receive, review, and respond to your application and enquiries.
- To deliver our programs and communicate with you about them.
- To operate our alumni referral program and process referral rewards.
- To improve our website, services, and applicant experience.
- To comply with legal obligations and enforce our terms.
Legal basis for processing
We process your personal data on the basis of your consent (which you may withdraw at any time), the performance of our agreement with you, our legitimate interests in running and improving the Program, and compliance with applicable law.
How we store and protect your data
Your data is stored on reputable, access-controlled cloud infrastructure. We apply reasonable technical and organisational measures to protect it against unauthorised access, loss, or misuse. While no system is completely secure, we work to safeguard your information and limit access to authorised personnel only.
Sharing your data — we do not sell it
We do not sell your personal data to third parties. We do not trade or rent your information. We only share data with trusted service providers that help us operate this website and our programs (for example, secure hosting and database providers), and only to the extent necessary for them to perform those services on our behalf. We may also disclose data where required by law or to protect our legal rights.
Your rights
Under the Kenya Data Protection Act, 2019, you have the right to:
- be informed of how your personal data is being used;
- access the personal data we hold about you;
- request correction of inaccurate or incomplete data;
- request deletion or removal of your personal data;
- object to or restrict certain processing; and
- withdraw consent at any time.
To exercise any of these rights — including requesting removal of your data — email us at info@usaprospectsprogram.com. We will respond within a reasonable time as required by law.
Data retention
We retain personal data only for as long as necessary to fulfil the purposes described in this policy, including for legitimate business, legal, and record-keeping purposes. Past applicant records may be archived for future program outreach unless you request removal.
Minors
Some of our applicants are students who may be minors. Where applicable, we expect a parent or legal guardian to consent to the provision of personal data. If you believe a minor has provided data without appropriate consent, contact us and we will take appropriate action.
Cookies and local storage
We use limited local storage and similar technologies, primarily to make referral links work and to keep the site functioning. We do not use this data to build advertising profiles.
Reservation of rights
We reserve all rights not expressly granted, including the right to update, modify, or amend this policy and our services at our discretion. Material changes will be reflected by updating the date at the top of this page.
Complaints and governing law
This policy is governed by the laws of Kenya. If you have concerns about how we handle your data, please contact us first so we can resolve the matter. You also have the right to lodge a complaint with the Office of the Data Protection Commissioner (ODPC) of Kenya.
